Court saves Upper West Side tower from wrecking ball

A New York State appellate court on Tuesday reversed a lower court’s ruling that would have forced the developers of 200 Amsterdam Avenue to remove about 20 floors from the nearly complete 52-story tower.

The appeals court rejected the argument by opponents of the tower that the developers illegally gerrymandered a zoning lot to cobble together more development rights than the project was entitled to.

” Today’s unanimous decision is an unequivocal affirmation that 200 Amsterdam’s permit was lawfully issued,” developer Steven Pozycki of SJP Properties said in a statement.

He cast the decision as a “victory for the Upper West Side and New York City’s economic recovery.” Pozycki said sales would be relaunched and the building could welcome residents this summer.

Representatives for the Municipal Arts Society and the Committee for Environmentally Sound Development, which in 2018 filed the lawsuit challenging 200 Amsterdam’s building permit, were not immediately available to comment.

Just wait till the UWS crazies hear there are even taller towers planned in the neighborhood. They need to start saving up for yet more harassing & frivolous lawsuits.

All the money those idiots spend on high-density real estate development lawsuits drives up demand for lawyers who are knowledgeable in the realm of high-end, high-density real-estate and ny development law.. and i dont think its too much of a stretch to suggest that any lawyer who knows that much about high-end, high-density real estate may, at some point, end up wanting some for themselves. If so, then, ironically, the more they get paid (and lawyers of this caliber always get paid, of course), the more demand you should expect for high-end real estate.. and thus for high-end real estate development..

I mean even if the developers did remove that many floors that’s more money out of their own pocket, so wouldn’t they just pass that cost onto the consumer and raise the condo prices? Where’s the logic in this?

If it occurred before folks started moving into units or before any contract was signed, yeah, why not.

But fortunately, logic prevailed, and the NIMBYS lost.
