1717 Bissonnet on hold, again. Judge denied the developers a request that would keep the plaintiffs from halting the project. The case now headed for a trial set to begin in November. The developers are still committed to the project.

If the courts find the road block does not have any legal standing then I hope the developers sue the hell out of those rich bastards fighting it. Why should a few rich be able to terrorize a legal venture in a city that has NO ZONING? All losses should be paid to the developer if the developer wins.

I'm kind of hoping it won't happen now and that the neighhborhood gets stuck with that fugly vacant lot for a while.

They've started taking depositions already. I don't think this projects going to be stopped for too long.

Houston's city attorney told a Harris County judge on Friday that halting the Ashby high-rise project would "irreparably impair future developments in the city," despite a jury verdict last year in favor of nearby residents who successfully sued developers of the 21-story tower planned for 1717 Bissonnet.

"The uncertainty surrounding the outcome of such lawsuits would hinder developers from financing, leasing and constructing real estate developments in Houston, which require long-term secure contracts," City Attorney David Feldman wrote in a letter delivered to state District Judge Randy Wilson. "We urge the Court to consider the serious public policy considerations involved."

A jury in Wilson's court last year sided with residents who opposed the project and awarded them $1.7 million in damages while agreeing the building would hurt their property values, damage their homes and create a traffic nuisance.

Four months after that verdict, Wilson will convene a hearing Monday for attorneys to present final arguments over whether the project should be allowed to move forward and how much of the jury damages the developer should pay.

Feldman's letter says the city is concerned that granting a permanent injunction would create uncertainty that could stall other developments. He noted that the project at 1717 Bissonnet is fully permitted and satisfies all deed restrictions as well as regulations that were in effect when it was approved.

On the one hand, I don't think the delays to this project have discouraged the determined developers (Hines simply relocated the dissident next door who complained). On the other hand, a city that has no zoning is no place where NIMBYism should prevail in court. If the neighbors object, they need to collect the signatures on an initiative to institute zoning. And good luck with that.

State District Court Judge Randy Wilson denied the motion for permanent injunction against the project, according to the Houston Chronicle. However, he didn’t throw out a jury's recent verdict that the tower should be considered a nuisance.

In December, the jury awarded damages to most residents who sued over the proposed tower at 1717 Bissonnet St. In his latest ruling, Wilson wrote, "Damages and an injunction are mutually exclusive" because awarding both "would constitute a double recovery." However, he said not all damages should be awarded yet.

Glad the judge was paying attention to this. You can't have your cake and eat it, too.

And it looks like preparations for the music festival on the project site are just about complete...

Swamplot just picked up on the moving of dirt on the site. As they call it in the tech biz, this is a soft launch.

The Ashby Highrise has caused Governing magazine to ask the $64,000 question: is Houston ready for zoning?

The city has issued a building permit for this one, so construction will finally begin soon.

I saw the permits for both the Post apartment development in Area (well, Hotel) 31 and the Pearl on Washington listed in HBJ. I would expect this one to be listed soon.

The permit just reached the HBJ. East Court Builders LLC is listed as the contractor.

Another false start or the actual beginning of construction? Workers were on site today.

The Houston developers have said construction of the tower will not be affected by the appeals process. They plan to move forward. Construction costs have risen during the course of the legal proceedings and the developers need to find a new contractor before they break ground, said Fred Cook, an attorney for the developers.
