Judge tosses suit to block Wolf Point project

'The developers of Wolf Point scored a victory in court today, when a federal judge threw out a lawsuit to block the riverside project.

U.S. District Judge Amy St. Eve dismissed a complaint filed by opponents of the massive development, which will encompass three towers and cost an estimated $1 billion. The joint venture building a 525-unit apartment high-rise on the site broke ground on the project last week. (Read the opinion below.)...'

Someone keep their eye on the values of River Bend units to see how they change as Wolf Point gets going. I bet if anything they go up.

There was never any doubt the court would come to this decision, but still amusing nonetheless. Perhaps now they will focus on pushing for the next two phases to have the best design possible when they go before public at a later date.

Now that the lawsuit is over and construction has started, can we reinstate Jarta? Maybe he can provide us with updates about the construction when they send information out to area residents and whether or not they will appeal the decision, or whether unit owners will sue the condo board for wasting money.

Today we celebrate, but the battle against NIMBYs is everlasting...

....tomorrow we suit up again, because there are many other good fights yet to be fought, and won....it never ends....

A thoroughly expected victory, but still an important one...

I wonder how much case law will need to be built up stating that you do not own your views before NIMBYs will give up on these frivolous lawsuits. The best part of this court ruling is that it can be used as further ammo to more rapidly strike down these garbage suits. All the city attorney has to say is "you are making the exact same arguments as Jarta vs City of Chicago 2013 and we all know how that ended, so tell me again what is different this time?" in the future.

The end summary of the court's findings:

In sum, Plaintiffs — who are adjacent property owners to Wolf Point — cannot establish that they have a constitutionally protected property interest. Because Amended PD-98 does not deprive Plaintiffs of a constitutionally protected property interest, the Court grants the City’s motion to dismiss with prejudice because, under the circumstances, Plaintiffs have no legal claim as a matter of law.

For these reasons, the Court grants Defendant’s Rule 12(b)(6) motion and dismisses this lawsuit in its entirety.

Indeed....just wondering aloud similarly over on the Navy Pier thread (see for the frivelous anti-development lawsuit du jour).....additionally, once we get a few of these tossed out properly, hopefully many fewer will even be filed....

I like this going down in history as Jarta v Chicago.

Frantic homeowners calling their lawyers to ask if there's anything they can do about a new development obstructing their views and being told that no, not since the landmark Jarta decision and yes, that will be $1500 for the consult.

From the crew - the valet service has take over the E bond lane of the upper ramp using it for diagonal parking.

^ Just noticed something in the ordinance. Any idea what is meant on page 5 when it says "prior to initiation of construction of each Phase beyond Phase I, the surface area of Phases II and III will continue to be operated as surface parking, in the same configuration that currently exists on those respective portions of the site ..." or how that figures in with what is currently going on on the site?
