Correct. 240' in height. So nearly a twin of Stewart. Glad they kept with the Aspire name. Duo sounded stupid.

Have some news on Derby. Did some sleuthing around and found out that back between June and July, lawyers for the Derby development hammered out a 36-month build extension with the City of Phoenix from the original agreement that was set to end this coming March. So basically, they have an additional 36 months now to build. Also, changes were submitted at the ground level to include benches and other infrastructural improvements to the previously approved abandonment area along McKinley (attached screenshot of this below).

Also, the parent name, Amstar McKinley LLC has been changed to Derby RR LLC. Yes, Derby is very much alive

Wasn't this really a matter of 6 feet that Engelhorn wanted so this building wouldn't prevent the redevelopment of his? And once he got his 6 feet he stopped caring?

The design as I understood it with the north facing windows on the lot line was insane to begin with. You have to build under the assumption your neighbor will do the same damn thing. Blocking those windows would have been a disaster.

Correct, hence the 6' of abandonment that was granted for the development, so they can essentially move the building plot over 6', lol. I get the window argument, but Stewart was able to include windows and balconies on the Northside and they have a 0' lot line. Go figure

Isn’t the lawsuit for this development still pending litigation? Last I saw a trial was scheduled sometime next year.

This appears to be litigation regarding the issue of GPLETs which is specifically with the City of Phoenix. I do not believe the developers of Derby are any longer involved in the court case. Not even sure if they are even seeking a GPLET any longer.

I see your point. I was under the impression that nothing could be built until this case completed litigation but I’m not a lawyer so I won’t try to pretend I know exactly what will happen.

Eh, me neither. It's hard to follow the minute entries as to what's specifically going on. Either way, my sleuthing only uncovered a 36-month extension to the development agreement and modifications to the ground level abandonment areas. Not a construction permit. So if they are indeed still waiting on the case, they have a 36-month window to build. Maybe they intend to build on the next cycle?
