A motion to stop the so-called Ashby high-rise project has been denied.
State District Court Judge Randy Wilson denied the motion for permanent injunction against the project, according to the Houston Chronicle. However, he didn’t throw out a jury's recent verdict that the tower should be considered a nuisance.
In December, the jury awarded damages to most residents who sued over the proposed tower at 1717 Bissonnet St. In his latest ruling, Wilson wrote, "Damages and an injunction are mutually exclusive" because awarding both "would constitute a double recovery." However, he said not all damages should be awarded yet.
