It's not true at all otherwise you wouldn't see developers willing to compromise their designs in order to satisfy the city's desire. The city is also willing to work with proposals I don't understand the need to vilify the city while the OMB is the hero that saves the developer from doom. Of course, I'm not irrational about development.

The typical case which isn't resolved outisde the court would go like this. The developer proposes 180 metres. The city wants 120 metres. The OMB approves 130 metres. Who do you think won?

Developers are consistently pushing the envelope. There rarely is pecedence for the OMB to rule in their favour without grossly overstepping their bounds by rewriting the zoning.
