A pair of local lawmakers said the project needs to be reassessed.

“We are extremely disappointed,” City Councilmen Chaim Deutsch and Mark Treyger said in a joint statement.

They have joined community activists and launched a petition, on change.org, imploring the city to stop construction.

Parks Department spokesman Sam Biederman defended the construction, arguing the new material is sturdier and cheaper.

“This project strengthens and extends the life of the boardwalk with recycled plastic lumber and concrete,” Biederman said.
“As a coastal city, it’s more important than ever for us to use resilient, sustainable materials,” he added.

Critics noted that the wooden portion of the 2.5-mile boardwalk, which runs from W. 37th St. in Sea Gate to Brighton 14th St., held up much better than concrete sections during Hurricane Sandy.

The conversion project resumed in November and the city expects to have it finished in time for the 2016 beach season, Biederman said.

Earlier in December, Deutsch and Treyger asked the city Landmarks Preservation Commission to name the 91-year-old boardwalk a historic site, a designation that would bar such dramatic changes.

The body is reviewing the petition, a process that is likely to take at least a year.

The pair has requested an expedited evaluation process, but it’s unclear whether that can be done.

Not all officials in Brooklyn are pushing for conservation.

The work is being funded in part by state Assemblymen Steve Cymbrowitz and Alec Brooke-Krasney, who helped the city obtain a $10 million New York State Assistance Grant, Biederman said.

New York City’s Department of Buildings today issued a work permit for iStar Financial to begin construction on its Coney Island beachfront amphitheater and restaurant, together called the Seaside Park and Community Arts Center, city records indicate. The permit allows for renovation of an existing building—the historic, now-vacant Childs Building at 3052 West 21st Street—and construction of a new amphitheater and related roof structure on an adjacent site. The total cost of the boardwalk project is $53 million.

“Every major market in the country has a covered 5,000-square-foot amphitheater,” Karl Frey, the executive vice president of land and development at iStar, told Commercial Observer. “Those tours sometimes skip over New York because we don’t.” He added: “There’s a real hole in the market.”

The three-story, 60,000-square-foot Childs Building will have a restaurant and the adjacent covered amphitheater will have 5,000 seats on the boardwalk, according to a project overview Mr. Frey gave this morning at a Brooklyn development event hosted by Baruch College’s Steven L. Newman Real Estate Institute, Kasirer Consulting and Zetlin & De Chiara.

The Childs Building, which was home to a Childs Restaurant before it vacated the property in 1952, will provide artist green rooms, offices and dressing rooms. A rooftop terrace overlooking the amusement district can hold 320 people.

“We’re building it on a turn-key basis with the city,” Mr. Frey said.

On April 10, the city bought the Childs Building and some of the land from iStar (a portion of the site was already city property), for $16.1 million. The city then leased the entire premises to Seaside Park LLC, a joint venture of iStar and Coney Island USA, a local not-for-profit which is responsible for construction, maintenance and operations. The lease is for 10 years.

“My property has been home to a business for the past 100 years without interruption. There is no blight,” said Carol Murray, owner of a targeted 9,000-square-foot parcel now occupied by the spinning Polar Express and other rides.

Dick Zigun, who runs the world-famous Coney Island USA and Circus Sideshow, later said he sympathizes with Murray but believes eminent domain is necessary because it will finally give the city land it needs to build a promised grand walkway connecting three landmarks: the Cyclone roller coaster, Wonder Wheel and Parachute Jump.

“Carol, I’m sorry you are losing your property, but I hope you get rich and make a lot of money,” by selling the land to the city, Zigun said.

Councilman Mark Treyger, who represents neighborhood, and other city officials said they still hope to work with Murray and the other landowners so the city can buy the property and avoid condemnation.

Murray afterwards said she’d listen to offers but is also considering taking legal steps to fight the land grab.

The city Parks Department will accept written testimony on the plan until November 2.

Despite the controversial nature of eminent domain, there has been little opposition to the plan first reported by The Post because most of the property is owned by absentee landlords who allowed their sites to become weed-strewn eyesores.

The lone exception is a 9,000-square-foot lot near the boardwalk that has long been home to a small, family-owned amusement business.

Carol Murray, the business owner, could not be reached for comment but called the city’s plan an “abuse of power” during an October public hearing.

Yes, enough of these people holding on to these properties with no intentions of doing anything ever. I'm glad de Blasio is pushing forward with many of the initiatives began under the Bloomberg administration.

“The community can rest assured that the buyer intends to use the Shore Theater as an entertainment venue and revitalize it after many decades of neglect,” said Igor Oberman, outside council for Pye Properties.

Oberman said he reached out to the dealmakers at Pye Properties before returning our request to confirm the sale. He said the company pursued buying the property because of its historical significance.

“Anybody in real estate knows that the Shore Theater is a cornerstone of Coney Island history,” he said. “This is a tremendous asset that the community wants to revitalize and it is an exciting way to kick off 2016.”

Pye Properties purchased the Shore Theater from Jasmine Bullard — daughter of the Kansas Fried Chicken mogul and Coney Island land baron Horace Bullard, who dreamed of revitalizing the People’s Playground through renovations of his many properties. When he bought the theater in 1978, he hoped to turn the building into a hotel and casino, but his efforts were stymied by the city and the property sat derelict ever since, the Brooklyn Eagle reports.

Since her father’s death in 2013, Jasmine has been under pressure to restore or sell the theater. The deteriorating property, built in 1925, had been been taken over by homeless squatters and many considered it to be a blight on the neighborhood, according to the Daily News.

The decision the sell the theater, the only landmarked property in Coney Island, comes at a time when the city is pressing forward with plans to seize some of the Bullard family’s other Coney Island properties through the use of eminent domain. City officials argued they were forced to use the controversial power, which allows the government to seize private property for the public’s use, because efforts to find a fair-market price with the owners of the dilapidated properties have failed.

Oberman said that plans to renovate the theater will still have to go through community board and Landmarks Preservation Commission because of the building’s historical status. However, he said the new owners will be seeking input from the community to determine how best to move forward.

“This building is an anchor in the Coney Island community,” he said. “It’s no longer going to be an eyesore or a menace to the neighborhood.”

The 135-unit development will span nearly 107,000 square feet at 2002 Surf Avenue and include nearly 8,000 square feet of commercial space, according to permit applications filed with the city’s Department of Buildings.

iStar leased the property from the city’s Economic Development Corporation last year, according to records, and the residential development will rise next to a new 5,000-seat amphitheater and waterfront restaurant that iStar is currently constructing at the landmarked Childs Restaurant site in Coney Island.

.....The development will hold “a philanthropic or nonprofit institution,” according to the filing, and is part of much larger plans by iStar to build 1 million square feet of housing near the Coney Island boardwalk, according to the company’s website.

It was destroyed by the hurricane. The previous owner intended to replace it. I don't think it has been, but haven't payed a lot of attention to it.

“It’s too far gone,” said Bullard,

The property owner says he plans to find a replacement sign, but wouldn’t speculate how much it will cost or how much he’s willing to spend on a building that hasn’t been opened to the public for decades. The building, which was built in 1925 and made a city landmark in 2010.

“The prices are just astronomic­al,” said Bullard, who’s come under fire for failing to maintain the choice property at the corner of Surf and Stillwell avenues. “The building looks different without the sign. It looks like it’s missing something.”

The city says that Bullard is legally required to keep the building’s historic facade intact, but Coney’s faithful claim that Hurricane Sandy did more to the Shore Theater than rip away its signature sign. There are darker problems within the building that Bullard has no intention of addressing, they claim.

Phase One of Surf Vets Place will add 135 units and 7,000 square feet of commercial space to a 170,000-square-foot parcel at the corner of West 21st Street and Surf Avenue. Residents will be steps away from the beach, and walking distance from the Brooklyn Cyclones stadium and Luna Park.

Plans filed in April indicate that 52 of the apartments will be available to households earning 60 percent of the area median income, which in 2015 was $86,300 for a family of four, while 82 apartments will be reserved for homeless veterans. The developers will build a new street, Ocean Way, to connect West 20th and West 21st streets at midblock, and all of the buildings in the development will face onto shared courtyards. The listings page highlights standard amenities, including a fitness center, rooftop terrace, laundry room, and bike storage.

Financing documents suggest that the development is projected to cost $68.8 million; construction on the first phase is expected to be complete by 2018.

Land around the former amusement park was rezoned for commercial and residential development in 2009. Renderings suggest that buildings up to 25 stories tall will be added at later stages of Surf Vets Place
, but when The Architect’s Newspaper reached out to CityRealty for comment, no employees were available to speak about the project.
