But the biggest thing that makes 5 pointz differ from those locations is its proximity to the skyline. It's not really just the scale of the warehouse that makes it special, but how being just a stone's throw away from midtown really adds to the character. East New York is so far flung out that whatever vacant warehouse stock that it does have wouldn't come close to filling the void that losing this one would create.

A federal district court jury in Brooklyn ruled that 5Pointz developer Jerry Wolkoff broke the law when he organized the overnight whitewashing of artists’ work at the former 5Pointz building in November 2013. Judge Frederick Block has yet to deliver a final verdict.

My Cousins place on Orchard Street just put up a super high fence and security dogs to keep the Artists out. It used to be a pickle factory and they are converting it to Lofts. The Westinghouse building was remediated for Asbestos by the Superfund. The hole where the Foundry was is huge. It must go down 60 feet. Cool stuff.

Wish they could have done what Miami did with Wynwood. Graffiti art is historically significant.

yrs later the developer loses his court appeal — so its some vindication for the grafitti artists. they will get paid:

wow, first the 200 Amsterdam ruling and now this. This state and city sure are doing their best to be a thorn in the side of developers. Makes you wonder about the future.

I don't care about graffiti, but I don't have any sympathy for the developers either if that article is accurate about what they did to the artists.

fyi — The Supreme Court declined G&M Realty’s petition to review the 5Pointz case, upholding a 2018 federal court ruling that awarded $6.7 million in damages to 21 artists at the site:

How do they have a right to damages if they didnt own the property? Is there something I'm missing?

yes there is something you missed -- reading the article beyond the headline!


In November of 2013, Wolkoff whitewashed 45 graffiti artworks at 5Pointz in the middle of the night without notifying the artists. Wolkoff, who died in July of this year, fought to overturn the ruling against him until the last days of his life after losing an appeal in court in February.

The 2018 ruling set a precedent for the protection of graffiti as an art form that falls under the “recognized stature” provision of the Visual Artists Rights Act (VARA). The court ordered Wolkoff to pay $150,000 for each destroyed work, the maximum award of statutory damages allowed under VARA.


personally, i don't really get it either, but they won the case.
